1. Introduction
Welcome to Senani Homes.
These Terms and Conditions govern your access to and use of the Senani Homes website and the information, services, and features made available through it.
Senani Homes is a construction and housing solutions business based in Sri Lanka. Established in 2008, the business offers services relating to house design, residential and commercial construction, design and build, renovation, construction consultancy, cost engineering, Bills of Quantities (BOQs), project planning, and other construction-related activities.
By accessing or using this website, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, please discontinue using the website.
These website terms are separate from any quotation, proposal, service agreement, construction contract, or other written agreement entered into between Senani Homes and a customer.
If you engage Senani Homes to perform a project, the applicable project agreement will establish the specific terms governing that engagement. Where these website terms conflict with a signed project agreement, the project agreement will prevail for that project, subject to applicable law.

Use the website for an unlawful or fraudulent purpose.

Introduce malicious software, harmful code, or other material intended to disrupt website operations.
Interfere with the availability, security, or proper functioning of the website.

4. Our Services
Senani Homes provides construction and related services according to the services advertised on our website and the specific arrangements agreed with each customer.
Our services may include:
4.1 House Design and Planning
We may provide architectural concepts, house plans, structural drawings, 3D designs, visualizations, and related planning services, depending on the scope agreed with the customer.
The precise deliverables, number of revisions, drawing formats, professional responsibilities, and applicable fees will be determined by the relevant quotation or agreement.
4.2 Design and Build
Our design-and-build services may cover planning, design coordination, construction, and project management under an agreed arrangement.
The scope of responsibility, specifications, project stages, and deliverables will be defined in the applicable project documentation.
4.3 Construction Services
We may undertake residential, commercial, renovation, remodeling, site development, maintenance, and other construction-related work.
The actual work undertaken will depend on the agreed scope, site conditions, availability of materials and labor, technical requirements, regulatory requirements, and other project-specific considerations.
4.4 Consultancy and Cost Engineering
We may provide construction advice, preliminary cost estimates, budgeting assistance, project planning, and other consultancy services.
Estimates and recommendations are prepared using the information reasonably available at the time. Actual costs may change because of market prices, design changes, site conditions, material specifications, labor rates, and other factors.
4.5 Bills of Quantities (BOQs)
Where offered, a BOQ may set out estimated quantities of materials, work items, and related information for a proposed project.
Unless expressly agreed otherwise, a BOQ or preliminary estimate should not be treated as an unconditional guarantee of the final construction cost. Its accuracy depends on the drawings, specifications, measurements, assumptions, and information available when it is prepared.
4.6 Assistance With Approvals and Financing
We may assist customers with information, documentation, or coordination relating to building approvals and bank loan applications, where included in the agreed service.
Final decisions concerning building permits, regulatory approvals, and financing are made by the relevant authorities, banks, or other responsible institutions. Senani Homes cannot guarantee approval, financing, or a particular outcome.
The availability and scope of these services may depend on the project, applicable requirements, and the written agreement with the customer.
5. Free Services and Promotional Offers
Our website may advertise certain services as free, including selected house plans, BOQs, cost-engineering advice, assistance with bank loan applications, and other promotional services.
A service advertised as free is subject to the following principles:
The offer applies only to the service and scope expressly identified in the relevant advertisement or written confirmation.
Additional work, extensive revisions, specialist services, site investigations, third-party fees, authority charges, or other expenses may be chargeable if they are outside the stated offer and have been disclosed and agreed in advance.
The availability of a free service may depend on project suitability, the information provided by the customer, and any clearly stated eligibility conditions.
A free preliminary estimate or BOQ does not automatically include a full detailed measurement exercise, tender documentation, or continuous project cost management.
A free house plan or design offer does not automatically include unlimited revisions, construction, authority fees, or every drawing and professional service required for a building project.
Any material conditions or limitations applicable to an offer will be communicated to the customer before the additional chargeable work is undertaken.
We will not treat an advertised free service as an agreement by the customer to purchase another service.
Nothing in this section removes any rights a customer may have under applicable consumer protection law.
6. Inquiries and Requests for Quotations
Submitting an inquiry through our website, email, telephone, or WhatsApp does not by itself create a construction contract or guarantee that Senani Homes will undertake the requested work.
To assess an inquiry, we may request additional information, including:
The project location.
The type and approximate size of the proposed construction.
House plans, drawings, photographs, or site details.
Your budget and preferred project timeline.
Your required services and specifications.
Other information reasonably necessary to prepare a proposal.
Customers are responsible for providing accurate information and informing us of any material changes.
We may decline an inquiry or propose an alternative scope of work where appropriate.
7. Quotations, Estimates, and Prices
Any quotation or estimate issued by Senani Homes will be subject to its stated scope, assumptions, exclusions, validity period, and other conditions.
Unless expressly stated otherwise in writing:
Preliminary estimates are indicative and may change following site inspection, detailed design, measurement, specification review, or supplier confirmation.
A quotation applies only to the work and materials expressly included in it.
Work not included in the accepted scope may require an additional quotation or variation.
Material price increases, changes to customer requirements, unforeseen site conditions, and regulatory changes may affect the project cost, subject to the applicable agreement.
Taxes, government charges, permit fees, utility charges, and third-party expenses will be treated as specified in the quotation or project agreement.
A quotation becomes binding only in accordance with its stated acceptance conditions and applicable law.
Customers should obtain written clarification of any unclear scope, exclusions, payment requirements, or cost assumptions before accepting a quotation.
8. Project Agreements and Acceptance
Before construction or other substantial project work begins, the parties should establish a written project agreement appropriate to the work involved.
Depending on the project, the agreement should identify:
The customer and service provider.
The project location and scope of work.
Drawings, specifications, materials, and quality requirements.
The agreed price and payment schedule.
The proposed commencement date and project duration.
The procedure for variations and additional work.
Responsibilities for approvals, site access, utilities, and other arrangements.
Inspection, completion, handover, and defect rectification procedures.
Applicable warranties, termination rights, and dispute resolution arrangements.
Work will commence when the relevant contractual prerequisites have been satisfied, including any required approvals, agreed initial payment, site access, and availability of necessary information.
Neither a website visit nor a general inquiry constitutes acceptance of a construction quotation.
9. Customer Responsibilities
Customers engaging Senani Homes are expected to cooperate reasonably with the agreed project requirements.
Depending on the project agreement, customer responsibilities may include:
Providing accurate project information and instructions.
Providing lawful access to the project site.
Disclosing known site restrictions, relevant hazards, and material information that may affect the work.
Providing documents and approvals that are the customer’s responsibility.
Reviewing and approving drawings, specifications, and selections within agreed timeframes.
Making payments in accordance with the agreed payment schedule.
Communicating requested changes in writing.
Avoiding instructions to carry out work that is unlawful or contrary to agreed safety requirements.
Cooperating with reasonable site inspections, measurements, and project coordination activities.
If a customer’s failure to meet an agreed responsibility affects the progress or cost of a project, the parties will address the resulting consequences in accordance with the project agreement and applicable law.
10. Construction Standards, Materials, and Quality
Senani Homes aims to perform agreed work with reasonable skill and care and in accordance with the applicable project agreement and legal requirements.
The materials, workmanship standards, specifications, and inspection procedures for a project should be defined in the relevant documentation.
Where appropriate, material substitutions or specification changes will be communicated to the customer and handled through the agreed variation procedure.
Product availability, supplier lead times, and manufacturing changes may affect material selection or delivery. No material change affecting an agreed specification should be treated as approved merely because it is commercially convenient.
Any inspection or quality assurance process will be governed by the relevant project agreement and applicable requirements.
11. Project Timelines and Delays
Project schedules are prepared using the information and circumstances reasonably anticipated at the time of planning.
The progress and completion of a project may be affected by:
Changes requested by the customer.
Delays in approvals or permits.
Delayed payments or decisions.
Unforeseen ground or site conditions.
Severe weather, flooding, or other natural events.
Material shortages or supplier delays.
Utility interruptions.
Labor availability.
Government restrictions or other events beyond reasonable control.
Where an event affects an agreed schedule, the parties should communicate promptly and address the impact in accordance with the project agreement.
Any extension of time, revised completion date, additional cost, or other contractual consequence will be determined under the applicable agreement and law.
We do not promise an exact completion date unless the relevant commitment is expressly established in the applicable agreement.
12. Changes and Additional Work
A customer may request changes to a design, material, specification, or construction scope.
Where a requested change affects price, time, materials, or other contractual obligations, it should be documented in writing before the changed work proceeds, except where urgent action is reasonably necessary for safety or protection of property.
A variation record should identify, where applicable:
The requested change.
Any additional or reduced cost.
The effect on the project schedule.
The effect on drawings or specifications.
Any revised payment arrangements.
The parties should approve the variation in accordance with their project agreement.
Verbal discussions alone should not be relied upon for substantial changes where written confirmation is reasonably available.
13. Payments and Invoices
Payment obligations will be governed by the accepted quotation and project agreement.
The applicable documentation should specify the amount payable, payment milestones, due dates, accepted payment methods, and any applicable taxes or additional charges.
Customers should retain receipts and payment confirmations.
If a payment dispute arises, the parties should communicate promptly and attempt to resolve it in accordance with the agreement.
Any consequences of late payment, suspension of work, interest, or recovery costs will apply only where properly provided for in the agreement and permitted by applicable law.
No payment obligation is created merely by browsing the website or submitting a general inquiry.
14. Site Safety and Access
Construction sites may contain hazards associated with excavation, machinery, building materials, electrical installations, work at height, and other activities.
Access to an active construction site may be restricted for safety, security, insurance, or operational reasons.
Customers, visitors, and other persons attending a site must comply with reasonable safety instructions and applicable site rules.
Responsibilities for site security, protective equipment, visitor access, and coordination with other contractors should be established in the project agreement.
Nothing in these terms transfers a statutory safety obligation to a person who is not legally responsible for it.
15. Plans, Drawings, and Intellectual Property
Unless otherwise agreed in writing, the intellectual property rights in the Senani Homes website, branding, text, graphics, original promotional materials, and other content owned by Senani Homes remain with the relevant rights holder.
Website visitors may view this material for personal, informational, and legitimate business inquiry purposes.
Without permission or another lawful basis, you may not reproduce, republish, distribute, modify, or commercially exploit protected content.
15.1 Project Drawings and Designs
The ownership, permitted use, reproduction rights, and licensing of architectural drawings, structural drawings, 3D models, BOQs, and other project deliverables will be determined by the applicable project agreement and relevant law.
Payment for a service does not automatically transfer every intellectual property right associated with a deliverable.
Customers should confirm whether their agreed rights include construction use, modification, repeat construction, sharing with contractors, or other intended uses.
15.2 Customer-Provided Materials
Customers who provide photographs, plans, documents, or other materials represent that they have the right to provide them for the intended project purpose.
Customers authorize Senani Homes to use those materials as reasonably necessary to assess, quote for, or perform the agreed service, subject to the applicable agreement and law.
15.3 Portfolio and Promotional Use
We will seek appropriate permission where required before publishing identifiable customer information, private project documents, or photographs of a customer’s property for promotional purposes.
Any use of customer-provided material remains subject to applicable privacy, confidentiality, and intellectual property requirements.
16. Website Content and Project Images
The website may display photographs, illustrations, sample designs, project images, conceptual drawings, renderings, and examples of construction work.
These materials are intended to provide information about our services and may not represent the precise outcome of every project.
Actual results can differ because of site conditions, dimensions, approved specifications, material selections, lighting, design revisions, and other factors.
Where a photograph or rendering is illustrative, it should not be treated as a contractual specification unless expressly incorporated into the applicable agreement.
Customers should rely on the final approved drawings, specifications, quotation, and project agreement for the requirements of their own project.
17. Building Approvals and Regulatory Compliance
Construction projects may require planning permission, building approval, permits, inspections, certifications, or other authorizations.
The requirements will depend on the project location, building type, applicable rules, and relevant authorities.
The project agreement should specify which party is responsible for preparing documents, submitting applications, paying fees, obtaining approvals, and coordinating inspections.
Where Senani Homes provides approval assistance, the service is limited to the agreed scope.
An authority’s decision remains outside our control. Customers must not assume that a design, estimate, or preliminary discussion constitutes an official approval or permission to begin construction.
Construction should proceed only when the approvals required for the relevant work have been obtained.
18. Bank Loan and Financing Assistance
If Senani Homes assists a customer with bank loan applications or related documentation, that assistance does not constitute a guarantee of financing.
Loan approval, interest rates, repayment terms, eligibility, valuation, and disbursement are determined by the relevant financial institution.
Customers should verify all loan conditions directly with the institution and ensure that any financial commitments are appropriate to their circumstances.
Unless separately agreed in writing, Senani Homes does not act as a bank, lender, or guarantor of a customer’s loan.
19. Warranties, Defects, and After-Service Support
Any express warranty or defect rectification arrangement applicable to a project should be stated in the project agreement or a separate written warranty document.
The applicable documentation should identify the covered work, warranty period, exclusions, procedure for reporting defects, and any maintenance requirements.
Customers should report suspected defects promptly through the agreed communication channel and provide reasonable information to help assess the issue.
Warranty conditions do not remove any mandatory rights or obligations imposed by applicable law.
Nothing in these website terms creates an additional project warranty that has not been agreed or required by law.
20. Cancellations and Termination
A customer or Senani Homes may cancel or terminate a particular engagement only in accordance with the applicable project agreement and applicable law.
The agreement should address circumstances such as non-payment, material breach, prolonged suspension, failure to obtain required approvals, or other grounds for termination.
Where cancellation or termination occurs, the parties should determine the status of completed work, materials ordered or supplied, outstanding payments, handover of documents, and any applicable refunds or other amounts.
Any cancellation charges or deductions must have an appropriate contractual or legal basis.
Nothing in this section excludes rights that a customer may have under applicable law.
21. Limitation of Liability
To the extent permitted by applicable law, Senani Homes will not be responsible for losses arising solely from a visitor’s use of general website information as a substitute for project-specific professional advice or an agreed service.
Information on the website is provided for general informational purposes. It is not, by itself, a construction contract, a final cost estimate, a certified structural assessment, a building approval, or a guarantee of financing.
For actual construction and consultancy services, the parties’ rights and responsibilities will be governed by the applicable agreement and law.
Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by law, including any applicable mandatory consumer rights or liability for matters that cannot lawfully be excluded.
Any contractual limitation of liability for a particular project should be expressly agreed in the relevant project documentation and reviewed for legal enforceability.
22. Indemnity
Where permitted by applicable law, a person who unlawfully misuses the website or infringes another person’s rights may be responsible for losses directly resulting from that conduct.
Nothing in this section makes a customer responsible for losses caused by Senani Homes’ own breach of contract, negligence, unlawful conduct, or other liability that cannot lawfully be transferred or excluded.
Any indemnity relating to a construction project must be considered in the context of the applicable project agreement.
23. Third-Party Websites and Services
Our website may contain links to third-party websites, map services, social media platforms, suppliers, or other external resources.
These links are provided for convenience or information. Senani Homes does not control all content, availability, policies, or security practices of external services.
Accessing a third-party website is subject to that provider’s own terms and policies.
We are not responsible for third-party content or services to the extent that the law permits, but this does not exclude liability that cannot lawfully be excluded.
24. Website Availability and Security
We aim to maintain a functional and secure website. However, uninterrupted access cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, hosting problems, technical failures, security incidents, or circumstances outside our reasonable control.
We may update, modify, suspend, or discontinue website features where reasonably necessary.
We will take reasonable steps to maintain website security, but internet communications and online systems cannot be guaranteed to be completely free from technical risks.
25. Privacy and Personal Information
Your use of the website may involve the collection and processing of personal information.
Our handling of such information is explained in our Privacy Policy, available at:
https://www.senanihomes.com/privacy-policy/
By submitting information through the website, you should review the applicable Privacy Policy to understand how your information is handled.
Any consent required for a particular use of personal information will be obtained where required by applicable law.
The Privacy Policy should be read together with these Terms and Conditions.
26. Complaints and Dispute Resolution
If you have a concern about our website, services, quotation, or project, please contact us first so that we can review the matter.
Where a complaint relates to an active construction project, please include the project reference, relevant dates, a description of the issue, and supporting documents where available.
We will seek to address complaints fairly and in accordance with the applicable agreement and law.
If the matter cannot be resolved directly, either party may pursue any available legal remedy or appropriate dispute resolution procedure.
Nothing in this section prevents a customer from exercising a right to seek assistance from a competent authority or court.
27. Governing Law and Jurisdiction
These Terms and Conditions are intended to be governed by the laws of Sri Lanka, subject to any mandatory legal requirements that apply.
Any dispute relating to these website terms will be handled by a competent court or other legally authorized forum in accordance with applicable Sri Lankan law.
A separate project agreement may contain additional dispute resolution provisions, provided those provisions are legally valid and enforceable.
28. Changes to These Terms and Conditions
We may update these Terms and Conditions from time to time to reflect changes to our business, services, website features, or legal requirements.
The latest version will be published on this page with an updated revision date.
Changes to website terms will apply to website use from the applicable effective date, subject to applicable law.
Changes to an existing construction contract will be governed by that contract and applicable law; publishing a revised website policy does not automatically amend an existing project agreement.
We encourage visitors to review this page periodically.
29. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Any invalid provision should be interpreted or adjusted only to the extent legally permissible to give effect to its intended purpose.
30. No Waiver
A failure or delay by Senani Homes to enforce a provision of these Terms and Conditions does not automatically constitute a waiver of that provision or any other right.
Any waiver will be effective only to the extent permitted by applicable law.
31. Entire Agreement
These Terms and Conditions govern the general use of the Senani Homes website.
They do not, by themselves, constitute the entire agreement for a construction, design, consultancy, or renovation project.
The specific project agreement, accepted quotation, approved scope, specifications, and other agreed documents will govern the relevant service, subject to applicable law.
